Club Terms & Conditions and Essential Information

Welcome to your VOLTGYM membership.

Your membership is governed by these terms and conditions (the “Terms”). You should therefore read these Terms carefully before you become a member as they explain your and our legal rights and also contain important information about our contract with you.

Your completion of the sign up process constitutes your acceptance of these Terms. If you are not prepared to accept these Terms, you should not complete sign up and should not use our service in any manner. Further, (for new and current Members) your continued access and use of our gym constitutes your acceptance of these Terms.

References to we, our or us in this privacy policy are to VOLTGYM.

References to you, or your, are to the Member.

Club Rules and Site Etiquette

Our club’s rules are prominently displayed throughout the facility, ensuring a safe and respectful environment for all. These rules MUST be followed, with failure to do so potentially resulting in the membership being revoked.

Opening Hours

Monday to Friday: 5:30 AM to 10:00 PM (Last entry at 9:30PM)
Weekends: 8:00 AM to 8:00PM (Last entry at 7:30PM)
Please exit the Recovery Room Facilities 30 minutes before closing time.

Membership Definitions

Adult: For individuals 18 years and older (or 16 with parental/guardian responsibility).
Student: 16+ with a valid student ID.
Junior: Ages 11-15, with at least one active adult member in the family.
Child: Ages 5-11, with at least one active adult member in the family.
Infant: Ages 0-5.

Membership Categories

Full Access Membership: Grants access to all club facilities during regular hours, including all classes (unless specified otherwise on the timetable) & recovery room facilities.
Gym & Class Membership: Grants access to the gym & all classes on the timetable (unless otherwise specified).
Gym Only Membership: Grants access to the gym only.
Under 18: Under 18 memberships fall into the same categories as above & grants the respective access.
Junior (11-16 yrs): Supervised gym access by a parent or guardian, and access to specified classes.

Membership Rules

  • Each member must have his/her fingerprint scanned for security & verification.
    When using the free weights you must return your weights to the rightful place once you have finished.
  • When using the kit, please wipe down any sweat using the blue roll & spray provided.
  • Appropriate clean exercise clothing & footwear must be worn whilst training (no bare chests or muddy shoes on the gym floor).
  • During busy times, please be respectful of how long you spend on a particular piece of equipment.
  • Please refrain from training in groups of more than 3 at all times to stop crowding in the gym.
  • Please respect the space around other members when they are training.
  • No hot food on the gym floor.
  • No pets (except guide dogs) on the premises.
  • Only food and drinks purchased within the Club are allowed.
  • No crockery or glass items are allowed.
  • Photography requires prior approval from the General Manager.
  • We may use photos & videos for promotional purposes; if you do not wish to be in the background of any content, please make this known to our videographer at the time.
  • No entry for individuals under the influence of alcohol or drugs.
  • Inappropriate behaviour will not be tolerated; please report any incidents to our staff.
  • Show care and respect for equipment, staff, and fellow members.
  • Please use lockers for your belongings. Any padlocks that are left on lockers overnight will be removed.
  • Lost property will be kept for 14 days, then donated to charity.
  • New members must complete a Par-Q before training in the gym.
  • A one-on-one gym induction is recommended.
  • Members should not engage in strenuous activity if medically unfit; consult your doctor when in doubt.
  • The Club reserves the right to close facilities for maintenance or renovations.
  • Smoking and e-cigarettes are prohibited, except in designated areas.
  • The Club may refuse entry without providing a reason.

Membership Terms

  1. Joining

1.1 You can complete the sign up process either online (at www.voltgym.co.uk) or on-site. Please make sure that the details that you provide to us about yourself are complete and accurate.

1.2 You must choose which membership you would like to activate on sign up. You will agree to pay any Joining Fee and any Promotional Code must be applied at this point. You will receive a welcome email & it is at the point where a contract is formed between you and us (“Contract”).

1.3 You must confirm that you are at least 16 years old and you have read, and will abide by, the Rules and Health Declaration. We reserve the right to amend the Rules at any time but will post updated Rules online.

1.4 Upon completion of your sign up process, you will receive a confirmation email from us, containing information on how to download our App & how to set up your access into the gym. Your Membership starts immediately unless stated otherwise.

1.5 You must ensure that all the details provided when you sign up and on your Health Declaration are true and correct. We reserve the right to refuse and/or cancel your Membership sign up application if we reasonably believe that the information you have provided is incorrect and/or false.

2. Payments

2.1 If you are a contracted Member, you agree to pay any Joining Fee, along with the first Monthly Fee and commit to payments for further Monthly Fees for each month in your contracted Member Period. Your contract period is a minimum term & upon completion will roll over onto a 30 day rolling contract, where payments will be taken each month until we receive a cancellation notice from yourself in writing via email to [email protected].

2.2 If you are a non-contract Member, you agree to pay any Joining Fee if included in the package along with the first Monthly Fee and a rolling payment of the Monthly Fee with no ongoing contract.

2.3 You must inform us of a Promotional Code on sign up. You agree to pay the Promotional Code rate applicable to your Joining Fee and/or Monthly Fee for the period of that Promotional Code. After that period has ended, we can then debit the normal Monthly Fee in respect of following months until your Membership is ended.

2.4 We will continue to debit all Monthly Fees even if you do not attend the gym and/or if there are circumstances which affect access to and use of the gym. Other than during an emergency, where there are occasions when we must close all, or certain parts, of the gym, we will provide reasonable notice in advance and will use reasonable endeavours to ensure that such closures are during quiet periods.

2.5 If any payment due from you is not received or a Direct Debit is not honoured without good cause, we are entitled to, and may charge you a £25 administration fee for dealing with the consequences on the account. This is a reasonable estimate of the administration costs which we will incur. If charged, this sum will be added to your account for the next payment to be made.

2.6 We may change the Monthly Fee for Non-contract Members at any time by providing you with 4 weeks’ notice. You can cancel your Membership within this 4-week period, but if you do not we will automatically apply the updated Monthly Fee. We will not change the Monthly Fee for contracted Members during their contracted Member Period but do reserve the right to amend a contracted Members Monthly Fee after that period ends.

2.7 If your initial Monthly Fee was part of any offer or Promotional Code, your Monthly Fee will be charged at the agreed promotional period and will then automatically change to the regular Monthly Fee at the end of the promotional/offer period.

2.8 If you fail to pay any amount due under this Contract for a period of more than 30 days, then we may pass this debt to a third party collection agency for collection. All reasonable costs incurred in the collection of this debt (including tracing you) by the collection agency shall be borne by you.

2.9 We reserve the right to end any promotion and/or Promotional Code without warning at any time.

During this period:

• if you are a Non-contract Member, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and Rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.

3. Membership Freeze

3.1 You can freeze your Membership at any time, for any reason, for a minimum of 1 month, providing you give 14 days’ notice. You can freeze the Membership for up to 6 months (the “Freeze Period”). You may only request 1 Freeze Period in any 6 months’ period. If you are a Contracted Member, your contract duration will pause and then recommence after the freeze.

4. Gym Closures

4.1 If VOLTGYM is forced to close for a prolonged period of time for any reason (“Closure Period”), then:

4.1.1 we shall be entitled to immediately suspend our provision of gym and/or membership services to you for the duration of the Closure Period; and

4.1.2 we may freeze your membership and suspend all collections of your payments to us for the duration of the Closure Period.

5. Cancelation Period

5.1 If you sign up to a Membership, you have the right to cancel this Contract within 14 days of completing your sign up process without giving any reason. (each 14 day period is a “Cancellation Period”). To do so you must inform us by a clear statement via email to [email protected]. You must send your cancellation request before the relevant Cancellation Period expires.

5.2 After the Cancellation Period expires, you may only cancel this Contract for those reasons detailed in paragraph 6.

6. Contract Termination By You

6.1 Once the relevant Cancellation Period (detailed in paragraph 5) has expired you may only terminate this Contract in the following ways:

6.1.1 If you are a Non-contract Member you can cancel your membership by contacting us via email to [email protected]. We will do the work for you, including cancelling your direct debit / card payment if it hasn’t already been requested from your bank. If you can give us 30 days’ notice, this helps us to complete the process before your next payment is due. If you do not give us 30 days notice, your next payment may be taken & will be non-refundable.

6.1.2 Non-contract Members can terminate this Contract at any time by cancelling the direct debit / card payment through Stripe inc. You should allow up to 10 working days for the bank to action this, depending on your bank. Monthly Membership will remain in force until the day before the next payment would be due, at which point it will terminate;

6.1.3 Contracted Members have agreed to sign up for the Contracted Member Period and therefore can only terminate this Contract within the Contracted Period in the following extenuating circumstances (proof will be requested).

(a) Relocation: in the event that your new permanent address is more than 15 miles away from VOLTGYM. Please provide written confirmation (e.g. a letter from your employer) to prove that the location of your residential address is more than 15 miles from the club, or provide written confirmation (e.g. utility bills) to prove that you have moved more than 15 miles from the club.

(b) Long term (over 3 month) illness or injury: in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer; or

(c) Redundancy: This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.

(d) Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given.

(e) within 30 days of giving you a notification of a price increase.

Please note – ANY Cancellation for the above reasons will not be affected until the appropriate proof is provided and received (in writing via email to [email protected]) to the club’s Membership Administration Department.

7. Contract Termination By Us

7.1 We may terminate this Contract with immediate effect for any reason, including if you:

7.1.1 are in breach of any part of the gym Rules;

7.1.2 we reasonably believe that the circumstances in your Health Declaration have changed or are incorrect and you have not updated us;

7.1.3 if the staff at the club reasonably believe your behaviour (such as complaints from other Members) is not of the standard expected of a Member; and/or

7.1.4 We reasonably believe that you have willingly allowed any other person to use your access to any part of the club.

7.2 Further and in the alternative, we reserve the right (at our reasonable discretion) to suspend and/or discuss your Membership if you breach the Rules.

8.1 Queries

9. Other legal remedies

9.1 The options described above are intended to describe or be in addition to your normal legal remedies and nothing in these terms will override or exclude any of your legal rights.

10. Limits of Our Responsibility

10.1 We are not responsible to you for the following types of loss or damage:

(a) of a kind that is not reasonably foreseeable;

(b) which results from you misusing the club and its equipment; or

10.2 However, nothing in this Contract is intended to limit or exclude our liability for death or personal injury caused by negligence or the negligence of our employees, fraud or fraudulent misrepresentation, or otherwise where we are not permitted to limit or exclude our liability by English law

11. Your Personal Information

11.1 When you contact us providing your details and/or during your use of the Membership, we may gather information about you and your visit to the club. Information about this can be found in our Privacy Policy which forms part of these Terms. The Privacy Policy and these Terms together govern our relationship with you.

11.3 For Direct Debit payment and card payment collection purposes you agree that your personal information may be processed by Stripe Inc.

11.4 We do not, and will not, sell any of your information to any third party, including your name, address, email address or credit card information. However, we do share your information with a number of select third parties to enable us to provide our products and services to you, to send marketing information and to improve our business operations.

11.5 When agreeing to these Terms and using the club, you consent to your image being recorded by 24-hour CCTV for security purposes (including review of use of Access Codes) and reviewed by our employees.

12. General Terms

12.1 The Contract will be between you and us. No other person shall have any right to enforce any of its Terms.

12.2 We may assign or otherwise transfer the benefit or burden of this Contract without your prior written consent. You may not transfer this Contract to anyone else.

12.3 Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

12.4 These Terms are governed by English law and you can bring legal proceedings in respect of any disputes arising out of or in connection with your Membership in the English courts.

13. Guests & Visitors

13.1 Members (over the age of 18) can bring guests to the club upon payment of the guest fee.

13.2 Members must always accompany their guest if paying a guest fee. This does not apply to the use of a singular guest pass.

13.3 The Club reserves the right to refuse any person admission as a guest to the Club without reason.

14. Studio Classes

14.1 Classes can be booked 7 days in advance through our online booking system or at reception.

14.2 Maximum class numbers are determined based on the size of the studio and the type of class. Once the maximum number is reached no other members will be able to enter the studio.

14.3 Failure to turn up to a pre-booked class may result in your booking privileges being removed, and a charge on your account of £4.50 per missed class.

14.4 If you are unable to attend a pre-booked class, please cancel your booking through our online booking system or contact VOLTGYM reception on 01704 893666 before the class is due to start so your place can be re-issued.

14.5 The warmup is an important part of the class to reduce the risk of injury, so please arrive on time. Failure to turn up 5 minutes before a class start time may result in your place being issued to a member on the waiting list.

14.6 Please inform the instructor if you have any injuries or medical conditions, or if your medical condition changes.

14.7 For your comfort and the comfort of others we ask all members to wear correct footwear and unrestrictive clothing.

14.8 An instructor may ask you to leave a class if you are behaving inappropriately.

14.9 Due to unforeseen circumstances, it may be necessary for VOLTGYM to change or even cancel a class at short notice. However, we will endeavour to provide as much notice as possible.

14.10 Please leave the studio promptly after the class to allow the next class to start on time.

Please do not enter the studio until the class before has finished and exited the area.

14.11 VOLTGYM requires a minimum of 3 participants for a class to take place.

14.12 Clothing, sports bags, and other personal items are not permitted in the studio, changing rooms and lockers are provided.

14.13 Members may use the studio when classes are not taking place, please ensure that all equipment is put back after use.

15. Lockers

15.1 Lockers are to be used for legitimate purposes only.

15.2 Please report any facility problems and/or injuries to club staff immediately.

15.3 Club staff reserve the right to check lockers to resolve safety/security concerns.

15.4 We will attempt to contact the member should this occur.

15.5 You must remove all your items from the locker when you leave the facility.

15.6 Daily lockers sweeps will take place to ensure belongings are not being left and lockers are not being reserved. If necessary, club staff will remove all contents and hold items within lost property.

16. Recovery Room

16.1 An induction is mandatory for first time use of the recovery room.

16.2 Members use the recovery room at their own risk & the club does not accept any responsibility for any harm or injury to any member unless caused by our negligence.

16.3 No running or potentially dangerous activity is allowed.

16.4 For reasons of health & hygiene, it is mandatory for all members to shower before entering the recovery room.

16.5 Members must correctly wear conventional swimming costumes.

16.6 Members must let Club staff know of any illness or disability that may affect them. This is for your safety as well as the safety of others.

16.7 Outdoor footwear must be removed prior to entering the recovery room.

16.8 Please do not bring oils, essences, or flammable items into the recovery room.

16.9 Soaps and shampoos must not be used in the thermal shower, ice bath or sauna.

16.10 Shaving and eating is not permitted in these areas – membership may be terminated immediately.

16.11 For hygiene purposes, towels must be used in the sauna for members to sit on.

17. Liability

17. 1 The Club’s liability for damage or loss to member’s property is strictly limited to any damage or loss suffered because of negligence of the Club, its staff, or its agents.

17.2 Without exception the Club will not accept liability for the safety of members, or their personal property brought onto the Club site, unless such property is handed to the Club reception & a signed receipt is given (this doesn’t include lost property). The Club reserves the right, in its absolute discretion, to refuse to store any such personal property of members. Property stored in lockers provided by the Club, or its agents are stored at the owner’s risk and no liability for loss or damage will be accepted by the Club. Cars parked in the Club car parks or elsewhere on the premises and all the contents in them are left at the owner’s risk and the Club will not accept any liability for loss or damage in respect thereof. The Club cannot accept any liability for any accident to any member that may occur on the premises or within the grounds of the Club other than liability, which may arise from negligence of the Club, its staff, or its agents.

17.3 Any member who suffers an accident on the Club premises or in the Club grounds must report the accident, and the circumstances under which it occurred, to the Club Manager immediately following the accident.
